Intellectual Property
All content on this website — texts, poems, photographs, graphic works, visual identity — is the exclusive property of Monde Primaire and is protected under intellectual property law.
Any reproduction, representation, adaptation or exploitation, in whole or in part, by any means whatsoever, without prior written authorization, is prohibited and constitutes infringement within the meaning of Articles L.335-2 and following of the French Intellectual Property Code.
Purchasing a work grants ownership of the physical item only. It does not transfer any copyright: the buyer holds no right to reproduce, publicly display, or commercially exploit the work.
Terms and Conditions of Sale
Article 1 — Purpose and Scope
These terms and conditions of sale govern the sale of works offered by Monde Primaire on the website mondeprimai.re.
Placing an order implies full and unreserved acceptance of these terms. They take precedence over any other terms, unless otherwise agreed in writing.
Monde Primaire reserves the right to amend these terms at any time. The terms applicable are those in force on the date of the order.
Article 2 — The Works
The works offered are original pieces or limited-edition prints, handmade. Each work is signed, numbered where applicable, and accompanied by a certificate of authenticity.
As the works are handmade, slight variations may exist between two copies of the same series, as well as between the delivered work and its photographic reproduction on screen. Such variations are inherent to the artisanal process and do not constitute a defect.
The photographs shown are for illustrative purposes. Colour rendering may vary depending on the display settings of the viewing screen.
Unless explicitly stated otherwise, works are sold unframed.
Article 3 — Price
Prices are indicated in euros, all taxes included, excluding delivery costs.
The applicable VAT rate is the one in force on the day of the order. VAT details appear on the invoice issued to the buyer.
Delivery costs are calculated and displayed before the order is finally confirmed, based on destination and the size of the work.
Monde Primaire reserves the right to change its prices at any time. Works are invoiced at the price in force at the time the order is recorded.
Article 4 — Order Process
The order process is as follows: selecting the work, reviewing the cart, entering delivery and billing details, choosing a delivery method, reviewing the order summary, then completing payment.
Payment confirmation constitutes the conclusion of the sales contract.
As works are offered as unique pieces or in strictly limited series, an order can only be fulfilled within the limit of available copies. Should unavailability be identified after an order is placed, the buyer will be informed without delay and fully refunded.
A confirmation email summarising the order is sent to the buyer once the order is validated.
Article 5 — Payment
Payment is made online by credit card at the time of order.
Transactions are processed by Stripe Payments Europe Ltd, a secure payment provider. Card details are transmitted directly to Stripe and neither pass through nor are stored by Monde Primaire, which has no access to them at any point.
The order is only recorded once payment has been effectively confirmed.
Article 6 — Delivery
Shipping time: works are shipped within 3 to 5 business days of payment confirmation.
Delivery areas: mainland France and internationally.
Transit times are in addition to the shipping time and vary according to destination and carrier.
Packaging: each work is carefully packaged — a rigid tube and tissue paper for works on paper, rigid corner-protected packaging for works on canvas.
Local pick-up: pick-up in Paris (Belleville) is available by appointment arranged after the order is placed.
Upon receipt, it is the buyer’s responsibility to check the condition of the parcel. In the event of visible damage, it is recommended to note reservations with the carrier and to inform Monde Primaire as soon as possible, including photographs where possible.
In the event of loss or damage occurring during transport, Monde Primaire will arrange for the work to be replaced where possible, or will issue a full refund.
Article 7 — Right of Withdrawal and Returns
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the buyer has a right of withdrawal.
Monde Primaire extends this period to 30 days from receipt of the work, beyond the legal minimum of fourteen days.
To exercise this right, simply send a request to contact@mondeprimai.re before the deadline expires. No justification is required.
Return conditions: the work must be returned in its original condition, undamaged, in its original packaging or packaging offering equivalent protection. The certificate of authenticity must accompany the return.
Return shipping costs are borne by the buyer, except in the case of a shipping error or a work delivered damaged.
Refunds are issued within a maximum of fourteen days from receipt of the returned work, using the same payment method as the original order.
The buyer’s liability may be engaged in the event the work’s value is diminished as a result of handling beyond what is necessary to establish its nature and characteristics.
Article 8 — Legal Warranties
Regardless of any commercial warranty, Monde Primaire remains bound by the following legal warranties:
- Legal warranty of conformity — Articles L.217-3 et seq. of the French Consumer Code: the buyer has two years from delivery of the work to take action, and may choose between repair and replacement, subject to the cost conditions provided for by law. The buyer is exempt from proving the lack of conformity during the twenty-four months following delivery.
- Warranty against hidden defects — Articles 1641 et seq. of the French Civil Code: the buyer has two years from discovery of the defect to take action, and may choose between cancellation of the sale and a price reduction.
These warranties do not cover the variations inherent to the artisanal nature of the works, as mentioned in Article 2.
Article 9 — Authenticity
Each work is accompanied by a certificate of authenticity stating, as applicable, the title, technique, dimensions, edition number and total print run.
The artist’s signature appears on the work.
Article 10 — Personal Data
The processing of personal data is described in the privacy policy set out on this page.
Article 11 — Disputes and Mediation
These terms are governed by French law.
In the event of a dispute, the buyer is invited to contact Monde Primaire to seek an amicable solution.
In accordance with Article L.612-1 of the French Consumer Code, consumers may make free use of a consumer mediator to seek an amicable resolution of the dispute.
Consumers may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
Failing an amicable agreement, the dispute will be brought before the competent courts.
Privacy Policy
Monde Primaire places particular importance on the protection of personal data and is committed to collecting only what is strictly necessary.
